Data processing when using our website
Provision of the website and creation of log files

As a matter of principle, we process personal data of our users only to the extent necessary to provide a functional website and our contents and services. When using our website for informational purposes only, i.e. when the user does not register or otherwise provide us with information, we only collect the personal data that the user's browser sends to our server.

The following data is collected:

1. information about the browser type and version used
2. the operating system of the user
3. the Internet service provider of the user
4. the IP address of the accessing user
5. date and time of server access
6. websites from which the user's system accesses our website (referrer URL)
7. websites that are called up by the user's system via our website

The data is stored in the log files of our system. This data is not stored together with other personal data of the user.

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. The legal basis for this data processing is Art. 6 para. 1 lit. f DSGVO.

The data is stored in log files to ensure the functionality of the website. In addition, the data is used to ensure the security of our information technology systems and for statistical evaluations for the purpose of operating, securing and optimising our online service, but also for anonymous recording of the number of visitors to our website (traffic) and the extent and type of use of our website and services. This is also our legitimate interest according to Art. 6 Para. 1 lit. f DSGVO.
The data is not evaluated for marketing purposes.
The data will be deleted as soon as they are no longer required for the purpose of their collection. In the case of the collection of data for the purpose of providing the website, this is the case when the respective session has ended.

 

Use of cookies

In addition to the aforementioned data, cookies are stored on the user's terminal device when using our website. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user's computer system. If a user calls up a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again.

These cookies are used to improve the quality of our website and its contents. Through these cookies we learn how the website is used and can thus constantly optimise our offer.

The user data collected in this way is pseudonymised by technical precautions. It is therefore no longer possible to assign the data to the calling user. The data is not stored together with other personal data of the users. 
When calling our website, users are informed about the use of cookies by an info banner and referred to this data protection declaration. 
We would like to point out that the storage of cookies can be prevented in the browser settings on the user's end device, thus allowing the user to retain full control over the use of cookies. The user can configure the browser settings according to his wishes and, for example, deactivate or restrict the transmission of "third party cookies" or all cookies. Already stored cookies can be deleted at any time. We would like to point out that the user may then not be able to use all functions of our website.

Link to the LWB tenant portal

On our website we offer users the option of going to our tenant portal "Meine LWB" (link). There, the user has the opportunity to register for use of our tenant portal "Meine LWB" by entering his or her e-mail address. The registration is not carried out via the website www.lwb.de. Further information on the processing of data in connection with the registration in the tenant portal "Meine LWB" and the concrete use of this portal is available at the appropriate place in the tenant portal.

 

Contact form and e-mail contact

On our website there is a contact form which can be used for electronic contact, for example to communicate inquiries, suggestions or searches for apartments and commercial premises. If a user takes advantage of this possibility, the data entered in the input mask (surname, first name, e-mail address and street, telephone number, postcode and city, if applicable) as well as his message will be transmitted to us and stored.

For the processing of the data, reference is made to this data protection declaration during the sending process.

Alternatively, it is also possible to contact us via the e-mail addresses provided at various locations. In this case, the user's personal data transmitted with the e-mail will be stored.

The data will be used exclusively for the processing of the conversation and for handling the contact with us. The legal basis for the processing of data in this context is Art. 6 para. 1 lit. f DSGVO. Does the establishment of contact via
e-mail or contact form is based on the conclusion of a contract, the additional legal basis for processing is Art. 6 Para. 1 lit. b DSGVO.

The data will be deleted as soon as they are no longer required for the purpose of their collection, or we will restrict processing if there are legal obligations to retain them.

The user has the opportunity to object to the storage of his personal data at any time. In such a case the conversation cannot be continued.

 

Integration of Google Maps

On this website we use map material from Google Maps, provider Google Inc, 1600 Amphitheatre, Parkway, Mountain View, CA 94043, USA. This enables us to display interactive maps directly on the website for our website users and allows them to comfortably use the map function.

In order to use the functions of Google Maps, it is necessary for Google to receive information about the user's visit to our website. In this context, the user's IP address and the above-mentioned log files are transmitted to Google. This is done regardless of whether the user has a user account with Google through which he or she is logged in when calling up our website, or whether no user account exists. If the user is logged in at Google, his data will be directly assigned to his Google account. If he or she does not wish to have the log files submitted associated with his or her Google Account, he or she must log out of his or her Google Account.

We have no control over the transfer of data to Google or the processing of data by Google. We are only aware that Google stores user data as user profiles for the purpose of advertising, market research and/or demand-oriented design of Google's own websites. In this respect, the user has a right of objection to the creation of these user profiles, whereby the user must contact Google to exercise this right. The use of Google Maps on our website is in the interest of an appealing presentation of our internet offer and easy findability of the locations we have indicated on the website. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO.

 

Rights of the data subject

If personal data of users of our website are processed, these are affected persons in the sense of DSGVO and they are entitled to the following rights against the responsible person:

1. the right to revoke a declaration of consent (Art. 7 para. 3 DSGVO):

The user has the right to revoke at any time any consent given to us to process his personal data. Revocation of consent does not affect the lawfulness of the processing operations carried out on the basis of the consent until revocation.

2. right of information (Art. 15 DSGVO):

The user has the right to demand information about the data stored about him/her. In particular, the user may request information about the purposes of processing, the category of personal data, the categories of recipients to whom his data has been or will be disclosed, the planned storage period, the existence of a right of correction, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of his data, if not collected from us, as well as the existence of an automated decision making process including profiling and, if applicable, meaningful information about its details.

3. right of rectification (Art. 16 DSGVO):

The user can demand that we immediately correct incorrect data concerning him. Taking into account the purposes of processing, he/she also has the right to request the completion of incomplete personal data.

4. the right of cancellation or "right to be forgotten" (Art. 17 DSGVO):

Under certain conditions, the user has the right to demand the immediate deletion of his data. We will comply with the deletion request, unless we are legally obliged or entitled to further store and process his data.

5. right to restrict processing (Art. 18 DSGVO):

The user can demand that we process his personal data only to a limited extent in some cases.

6. right to data transferability (Art. 20 DSGVO):

In accordance with Art. 20 DSGVO, the user has the right to receive from us personal data provided by him in a structured, common and machine-readable format.

7. the right to appeal to a supervisory authority (Art. 77 DSGVO in conjunction with § 19 BDSG):

The user has the right to complain to a data protection supervisory authority, in particular in the EU member state of his place of residence, his place of work or the place of the alleged violation, if he believes that the processing of data concerning him is in breach of the DSGVO. This is without prejudice to any other administrative or judicial remedies to which he or she may be entitled.

8. right of objection (Art. 21 DSGVO):

Data security

When calling up and visiting our website, we use the widespread SSL (Secure Socket Layer) procedure in connection with the highest encryption level supported by the user's browser. The user can see whether an individual page of our website is transmitted in encrypted form, for example, by the closed display of the key or lock symbol in the lower status bar of his browser.

However, we would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is therefore not completely possible.

We also use suitable technical and organisational security measures to protect user data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorised access by third parties. Automated decision making | Data transfer to third parties

An automated decision making process based on the personal data collected does not take place.

As a matter of principle, we only use personal data of users within our company. If and to the extent that we should involve third parties in the fulfilment of contracts, they will only receive personal data to the extent that the transmission is necessary for the corresponding service. We conclude appropriate data protection agreements with external service providers who act for us as processors in accordance with Art. 28 DSGVO.

Data is not transferred to bodies or persons outside the EU and is not planned.
